Terms of Service — The Premium Shisha

1. Definitions

“The Premium Shisha” (ABN 822 895 604 14), trading as “The Premium Way” and referred to as “we”, “our”, “us.”
“Site” means https://thepremiumshisha.com.au and associated domains/sub-domains.
“You” / “your” means any visitor, account-holder or purchaser.
“Products” means adult-use flavour consumables and accessories lawfully supplied in Australia. Some Products are subject to restricted imagery and limited descriptive detail under Australian guidelines.

2. Age & Eligibility

You must be 18 years or older to access or purchase from this Site.
By using the Site, you warrant that you are 18+ and legally permitted to purchase in your jurisdiction.
We may require age/identity verification before dispatch. Orders that fail checks may be cancelled and refunded (less verification or processing costs, where applicable).

3. Accounts, Orders & Availability

You are responsible for keeping your account details secure and preventing unauthorised access.
All orders are subject to real-time stock and our acceptance. We may refuse, limit or cancel any order (including for suspected non-compliance, fraud, identity mismatch, or stock errors).
Prices include GST unless stated otherwise and may change without notice. No refunds or credits are provided for price movements after purchase.

4. Payment

Accepted methods: PayID, Bank Transfer, Osko.
Some payment methods and discount codes may be unavailable for certain Products to meet compliance and risk controls.
Orders are processed only after cleared funds are received in full.

5. Presentation & Restricted Content

Applicable Australian guidelines restrict the presentation of certain Products.
Accordingly, images, logos and detailed flavour descriptors may be hidden or limited on the Site. This may affect search, filters and product detail displays.

6. Responsible Supply

We supply adult-use Products only to eligible customers. We may refuse or cancel supply where required by law or our responsible-sale policies.
We may request additional information to confirm age, identity, delivery suitability or order legitimacy.

7. Shipping, Delivery & Risk

Tracked delivery Australia-wide via third-party carriers. Discreet packaging as standard.
Risk in the Products passes to you on delivery scan at your nominated address (or at the point of authority-to-leave, if you select ATL).
Delivery times are estimates. If a parcel is delayed, lost or damaged, contact us promptly so we can assist with a carrier enquiry or claim.

8. Returns & Australian Consumer Law

Returns are governed by our Returns & Refunds Policy (incorporated by reference).
Your rights under the Australian Consumer Law (ACL) apply in addition to our policy. Where a refund is due under our policy, we may provide store credit unless the ACL requires a monetary refund.

9. Product Use & Health

Products are intended for adult use only. We make no therapeutic or health claims.

10. Prohibited Conduct

You must not: (a) purchase on behalf of anyone under 18; (b) misuse the Site or Products; (c) provide false or misleading information; (d) attempt to circumvent any age, identity or delivery controls.

11. User Content & Reviews

You are responsible for any content you submit (e.g., reviews). We may remove content that is unlawful, misleading, promotional, offensive, or inconsistent with our policies or applicable guidelines.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim relating to a purchase is capped at the amount you paid for that order.
We are not liable for indirect, special, punitive or consequential loss (including lost profits, data or goodwill).
Nothing in these Terms excludes liability that cannot be excluded or limited under the ACL, nor for death or personal injury caused by our negligence, or fraud.

13. Indemnity

You agree to indemnify and hold us harmless from claims, losses, damages, costs or expenses arising from:
(a) your breach of these Terms; (b) your misuse of the Site or Products; (c) your violation of any law or third-party right.

14. Intellectual Property

All Site content (text, graphics, trademarks, code) is owned by or licensed to us. Reproduction or distribution without prior written permission is prohibited.

15. Privacy

We collect and handle personal information (including age/identity verification data) in accordance with our Privacy Policy, which forms part of these Terms.

16. Suspension/Termination

We may suspend or terminate your account or access at any time for breach, suspected fraud, unlawful conduct or as required by law.

17. Amendments

We may update these Terms by posting the revised version and effective date on the Site. Continued use of the Site constitutes acceptance of the updated Terms.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
