These terms apply to your use of this website and to any order you place on it. Nothing in these terms limits your rights under the Australian Consumer Law.

1. Who you are dealing with
This website is operated by Jai Samadhi Pty Ltd (ABN 56 693 253 940), trading as The Premium Shisha, referred to below as "we", "our" and "us". "You" means any person who visits this website, holds an account or places an order. "Products" means the goods offered for sale on this website.
The Premium Shisha does not sell e-cigarettes, e-liquids, vapes or nicotine pouches.
2. Who can buy
You must be 18 years or older to buy from this website. By placing an order you confirm that you are 18 or older.
We may ask for photo identification before an order is sent. If age or identity cannot be verified, we may cancel the order and refund it in full.
3. Orders and prices
An order is an offer to buy. A contract is formed when we accept the order. We may decline or cancel an order, including where stock is unavailable, where details cannot be verified, or where we suspect fraud. If we cancel an order you have paid for, we refund it in full.
Prices are shown in Australian dollars and include GST. The price that applies to an order is the price shown when the order is placed.
Discount codes do not apply to tobacco products.
4. Payment
We accept Visa and Mastercard credit cards, PayID and bank deposit. We do not accept American Express, PayPal or buy now pay later services.
Orders paid by PayID or bank deposit are sent once payment is received in full.
5. Shipping and delivery
Shipping rates, delivery timeframes, Authority to Leave, and damaged or missing parcels are covered by our Shipping Policy, which forms part of these terms.
6. Returns and refunds
Returns and refunds are covered by our Refund Policy, which forms part of these terms. Your rights under the Australian Consumer Law apply in addition to that policy.
7. Product use
Products are for adult use. We make no therapeutic or health claims about any product.

8. Your conduct and your content
You must not buy on behalf of a person under 18, give false information, or attempt to bypass any age, identity or delivery check. You are responsible for keeping your account details secure.
You are responsible for any content you send us or submit through this website. We may remove content that is unlawful, misleading or offensive.
9. Our content
The text, images, code and trade marks on this website are owned by or licensed to us. You may not reproduce or distribute them without our written permission.
10. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.
Subject to that, we are not liable for loss that was not reasonably foreseeable, or for loss caused by something outside our reasonable control.
11. Suspending or closing an account
We may suspend or close an account where these terms are breached, where we suspect fraud or unlawful conduct, or where the law requires it.
12. Changes to these terms
We may update these terms. The terms that apply to an order are the terms published on this website when the order is placed.
13. Privacy
We handle personal information in accordance with our Privacy Policy.
14. Governing law
These terms are governed by the laws of Victoria, Australia. Courts in Victoria have non-exclusive jurisdiction.
